1. Agreement

This agreement ("Agreement") is between you, the User, and Quetix SIA with its registered address at Rīga, Dammes iela 31-29, LV1069 Rīga, Latvia, operating as FridayTicket (here and after "FridayTicket", "we", "us"). By using this site, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions, our Privacy Policy and all applicable local, state, national, and international laws and regulations.

FridayTicket reserves the right to modify these Terms and Conditions at any time. Your continued use of the site following any changes signifies your acceptance of the new terms.

2. Cooperation Overview

FridayTicket, the owner of the website https://fridayticket.com/en (hereinafter referred to as the "Platform"), operates as an online ticket sales platform. In its capacity as the Platform owner, FridayTicket collaborates with the System Owner and Event Organizers under separate agreements.

• Platform and System Usage: FridayTicket utilizes the ticketing system provided and maintained by the System Owner to facilitate and manage the sale of Tickets through the Platform.
• Agreements with Third Parties: FridayTicket enters into contractual agreements with Event Organizers and Authorized Sellers to ensure the effective management and conduct of Ticket sales.

3. Definitions

In these Terms and Conditions, the following definitions apply:

• "Authorized Seller": Refers to an individual or entity that has entered into an agreement with FridayTicket to sell Tickets through the FridayTicket Platform.
• "Event Organizer": Refers to an individual or entity responsible for planning, coordinating, and managing an event.
• "Order": Refers to one or more Tickets for a single Event, selected by the Ticket Buyer from the System and consolidated under a single identification number.
• "Reservation": Refers to a formed Order that is pending payment by the Ticket Buyer.
• "Site" or "Platform": Refers to the FridayTicket website and any associated web pages or applications.
• "Service Fee": Refers to funds charged to the Ticket Buyer during the sale of Tickets for Reservation and sale of Tickets services.
• "System": Refers to the comprehensive software platform upon which the Site operates.
• "Ticket Buyer": Refers to an individual who purchases a Ticket through the FridayTicket Platform.
• "Ticket": Refers to a proof of purchase or entitlement issued by an Authorized Seller, granting the holder the right to attend a specified event.
• "Widget": Refers to a component of the System that facilitates communication between the Ticket Buyer and the Authorized Seller.

4. Usage of Terms

• Genders and Pronouns: Words importing any gender are intended to include all genders.
• Number and Plurals: Words used in the singular form include the plural form and vice versa.
• Headings: Headings and section titles are provided for convenience only.
• Interpretation: Any terms not specifically defined herein shall be interpreted in accordance with their common usage and context.

5. Registration on the Site

Users may browse the Site without registering; however, to access certain features such as making a Reservation, placing an Order, or purchasing a Ticket, registration is required. During the registration process, users must provide a valid email address.

Users are strictly advised not to share their account username and password with any third parties. The Ticket Buyer/User is solely responsible for maintaining the confidentiality of their username and password and for all activities that occur under their account.

6. Services

FridayTicket operates as an online Platform enabling registered users to purchase Tickets for various events. FridayTicket acts solely as an intermediary between Event Organizers or Authorized Sellers and the Ticket Buyer.

7. Applicability

By purchasing Tickets through the appropriate Widget, you, the Ticket Buyer, agree to the terms set forth by the Authorized Seller. By using the Site, you consent to the transfer of your data to the Authorized Seller.

8. Third-Party Terms

The third-party sites including a Widget where purchases are made have their own terms and conditions, privacy policies, and practices. Users are advised to review and familiarize themselves with these terms and policies before completing a purchase.

Entry to any event is contingent upon adherence to the specific terms, conditions, and rules set forth by the Authorized Seller, Event Organizer, and venue operator.

9. Payment Procedure

9.1 Payment Methods

You are entitled to pay for Tickets using any of the payment methods made available on the Widget. Payment is deemed complete when the payment institution confirms the successful transaction.

9.2 Order Completion

Upon receipt of the full payment by the Authorized Seller, the Order is considered complete, and you will be granted the right to attend the event.

9.3 Tax Responsibilities

FridayTicket is not responsible for the calculation, collection, or payment of taxes related to the sale of Tickets, except where FridayTicket is legally required to do so.

9.4 Payment Processing

Payments for Tickets are processed directly by the Authorized Seller. FridayTicket does not collect or have access to your payment information.

10. Refunds

10.1 Obligation of Authorized Sellers

The responsibility for processing refunds lies exclusively with the Authorized Sellers. Refunds will be issued only in instances where an Event is officially canceled.

10.2 Amount of Refund

In the event of a cancellation, the Ticket Buyer shall be entitled to a refund equal to the face value of the Ticket. Service Fees and any costs associated with additional services are strictly non-refundable.

10.3 Refunds for Postponed or Rescheduled Events

In cases where an Event is postponed, rescheduled, or otherwise modified, the responsibility for any potential refunds rests with the Authorized Sellers.

10.4 Limitation of Liability for FridayTicket

FridayTicket does not bear responsibility for managing refunds, returns, or exchanges related to Ticket purchases.

11. Ticket Buyer's Responsibilities

Before purchasing a Ticket, you should review the Authorized Seller's legal entity, terms of sale, and privacy notice. If you do not agree with any of these terms, you are advised not to proceed with the Ticket purchase.

12. Responsibilities of the Authorized Seller

The Authorized Seller is responsible for setting the prices of Tickets and ensuring that all Tickets sold are in compliance with applicable legal requirements.

13. Responsibilities of the Event Organizer

The Event Organizer is responsible for the actual conduct of the event and for ensuring that the Ticket Buyer can access the event in accordance with the Ticket(s) purchased.

14. Role and Limitations of FridayTicket

• 14.1 FridayTicket reserves the right to require the Ticket Buyer to fully comply with the Order registration and payment procedures.
• 14.2 If the Ticket Buyer has accumulated more than two (2) unpaid Reservations within a single calendar month, such Reservation can be cancelled.
• 14.3 FridayTicket retains the right to modify, update, or suspend any software associated with the Site, System, or Widget.
• 14.4 FridayTicket reserves the right to unilaterally set and adjust tariffs for its Services at any time.
• 14.5 FridayTicket has the right to include and charge a Service Fee as part of the price of the Order.
• 14.6 FridayTicket reserves the right to demand full payment for the Ticket from the Ticket Buyer.
• 14.7 Any completed Order if it has not been paid during the designated Reservation Period can be canceled.
• 14.8 FridayTicket reserves the right to refuse further services to the Ticket Buyer in case of non-compliance.
• 14.9 The services are offered on an "as is" and "as available" basis.

15. Age Requirement and Legal Capacity

The services provided by FridayTicket are intended for users who are 18 years of age or older. By accessing and using the services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

Please be advised: We are unable to prohibit minors from accessing our Site and must rely on parents and guardians to determine what materials are appropriate for viewing and purchasing by children.

16. Authorized Seller Terms

Any terms and conditions, privacy policies, or practices provided by the Authorized Seller are not under the control of FridayTicket. FridayTicket is not responsible for the accuracy or completeness of such terms.

17. Disclaimer of Liability

• Event Determination: FridayTicket is not responsible for determining or setting the specifics of the events.
• Payment Processing: FridayTicket does not handle payment processing and is not liable for any issues arising from payment transactions.
• Refunds and Returns: FridayTicket is not responsible for any refunds, returns, or exchanges related to Ticket purchases.
• Event Impression: FridayTicket is not liable for any negative impressions or dissatisfaction experienced by the Ticket Buyer.

18. Intellectual Property Rights

18.1 Ownership and Rights

All content, materials, and intellectual property associated with the Site are the exclusive property of FridayTicket or its licensors.

18.2 Third-Party Intellectual Property

The Site may feature content, trademarks, or other intellectual property owned by third parties.

18.3 Authorized Use

Users are granted a limited, non-exclusive, non-transferable license to access and use the Site solely for personal, non-commercial purposes.

18.4 Prohibited Activities

• Unauthorized copying, reproduction, or distribution of content
• Reverse engineering of any software or technology
• Commercial exploitation without explicit authorization

19. Miscellaneous

19.1 Compliance with Event Rules

You agree to adhere to all applicable rules, policies, regulations, and conditions established by the Event Organizer.

19.2 Public Nature of Events

You acknowledge that events are public, and that your appearance and conduct within and around the venue are public.

19.3 Searches and Security

You and your belongings may be searched upon entering the event. By purchasing a Ticket, you consent to such searches.

19.4 Prohibition on Ticket Resale

The illegal resale of Tickets is grounds for possible seizure and cancellation without compensation.

19.5 Fraud Prevention and Account Suspension

FridayTicket reserves the right to screen Ticket sales for signs of fraudulent activity.

20. Liability

20.1 Entire Agreement

These Terms of Use constitute the entire agreement between the parties concerning the subject matter hereof.

20.2 Severability

If any provision is found to be invalid, such invalidity shall not affect the remaining provisions.

20.3 Disclaimer of Warranties

FridayTicket does not warrant that the Site will be uninterrupted, error-free, or free from failures.

20.4 Limitation of Liability

In no event shall FridayTicket be liable for any damages arising from the use of the Site.

20.5 Force Majeure

The parties shall be released from liability for non-fulfillment resulting from force majeure circumstances.

20.6 Claims Submission

All claims must be submitted in writing within ten (10) calendar days from the date the claim arises.

21. Dispute Resolution and Jurisdiction

21.1 Grievance Procedure

All disputes shall first be resolved through a grievance procedure. The Claimant must submit a written claim to FridayTicket within ten (10) calendar days.

21.2 Escalation to Legal Proceedings

If unable to resolve through grievance procedure, disputes shall be resolved in accordance with the legislation of Hungary.

21.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary.

22. Assignment and Transfer of Rights

FridayTicket may assign or transfer its rights and obligations under these Terms at any time. The Ticket Buyer may not assign or transfer its rights without FridayTicket's prior written consent.

23. Notices

Notices from FridayTicket will be sent to the Ticket Buyer via email to the address provided during registration. Such notices will be considered delivered 24 hours after the email is sent.

24. Security and Data Protection

FridayTicket employs secure server software (SSL) to ensure secure business transactions. All systems are safeguarded by a secure firewall infrastructure. Additional details are provided in our Privacy Notice.
